DMCA Copyright Notice

A notice that does not contain the required information may be delayed, rejected or found legally ineffective.

Response to a Copyright Notice

After receiving a substantially complete notice, we may:

  • Review the identified material
  • Request more information
  • Remove the material
  • Restrict access to the material
  • Notify the person or organization that supplied it
  • Provide that person with a copy of the notice
  • Take any other action permitted by law

Removal or restriction does not constitute an admission that infringement occurred.

Counter-Notification

If you believe material you supplied was removed or restricted because of mistake or misidentification, you may submit a written counter-notification.

The counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or restricted.
  3. The location where the material appeared before it was removed or restricted.
  4. A statement under penalty of perjury that you have a good-faith belief that the material was removed or restricted because of mistake or misidentification.
  5. Your name, mailing address, telephone number and email address.
  6. A statement that you consent to the jurisdiction of the United States Federal District Court for the judicial district in which your address is located.
  7. If your address is outside the United States, a statement that you consent to the jurisdiction of a United States Federal District Court in which Buffalo Digital Advertising may be found.
  8. A statement that you will accept service of process from the person who submitted the original infringement notice or that person's authorized agent.

Restoration of Material

After receiving a valid counter-notification, we may provide a copy to the person who submitted the original notice.

Subject to applicable law, the removed or restricted material may be restored unless the original complaining party informs us within the legally required period that a court action has been filed seeking to restrain the disputed activity.

We may decline to restore material when another lawful reason supports its removal.

Repeat Infringement

Where appropriate and legally required, we may restrict or terminate access by users who repeatedly infringe copyrights.

The Website does not currently provide general public accounts or open public posting features. This provision applies if such services are added or if repeated infringement occurs through another Website feature.

False Claims and Misrepresentations

Knowingly making a material misrepresentation in a copyright notice or counter-notification may result in liability for damages, costs and attorneys' fees.

Do not submit a copyright notice merely because you dislike material, disagree with it or believe it refers to you.
